I am trying to fin out if in the state of CA, does the owner of a property who is offering a lease option to buy get to pocket the initial option to buy deposit or does it have to go into an escrow account until the sale of the house? Same thing with any additional amount above the rent, does this get deposited into an escrow account as well?

Are there any good rent to own or lease with option to buy websites, that are free? Here's the deal, i really want to buy a house in this economy but my credit and my husbands are horrible (we're in the 500's). Hello, We are considering making a lease to buy offer on a home and I am wondering when we can lock in the interest rate for the home. For example, if we lease for 12 months, with the option to buy, do we have to wait until the end of the lease in 12 months to secure the interest rate or can we lock it in as soon as they sign the lease to buy contract now? My husband and I are in a lease with option to buy contract......? During all the paper signing we signed a paper that said that we checked the house completely. Meaning electrical and plumbing. We looked into everything to make sure it all looked fine. We didn't have it done professionally. We were informed there was no termite damage. We have found some in almost every room. Since we signed that paper are we pretty much bound to our contract? The owner is planning on us buying the house. She is even having a new roof put on this week. What are my options?
I am living in a house that I went into under a lease with option to buy agreement.? I lost my job shortly after entering into this lease with option to buy. I put $2,500 up front and any amount over the rent $500 was to go toward the downpayment. The landlord will not make any repairs. I have paid for all of the repairs and upkeep of the house for almost two years. I have however been late with the rent several times. He has accepted it but continues to charge late fees on a ongoing basis and each month says that he is going to put me out. I have invested all the money that I had into this house and he wants me to move out and he keeps all of the money. I don't think this is right since I have made all repairs and upkeep to the house since I have been here. Is there anything that I can do legally?

Should I sell, rent, or lease with option to buy? I currently own a townhouse in the Los Angeles area and need to relocate to another city due to a job. Since home prices are going down, I thought it would make sense to rent my property rather than sell it and not get my money's worth. I hired a property manager and she is supposed to be finding me a tenant. She asked me if I was interested in leasing with an option to buy and I told her I would think about it. Now she is suggesting that I sell because prices are only going to continue to go down and I will only make $200/month profit by renting when I could get $150,000 profit by selling and then reinvesting in more rental property. i leased a house with the option to buy? but the person who leased me the home owes more on the house than he agreed to sell it to me. i paid him option money $5000 that goes towards the purchase price and a extra $200 that pays down the greed purchase price. Leasing with option to buy, but no lease? Please read? I am writing this for my parents. Basically a couple years ago they put down 10,000 dollars on a house that was suppose to be put into their name and financed by them to buy out the owner. A year after living here they still couldnt get the financing. The owner of the property never reinstated a lease of ANY KIND to them but still wants them to live here and try for financing next year. The owner (who really doesnt own the house, just has power of attorney of it) comes by and harasses my parents weekly for MORE money. He charges them 750 per month, and asks for a 50 dollar fee to come pick the "rent" up, even though he lives in the neighborhood. He has also saved checks and tryed to deposit old checks that he ended up getting cash for because he has come to their house and demanded it. My parents have never really even been late with the rent. They keep getting charged off the wall "fees." The owner of the house never gave them a new lease, and the expired lease-option-to-buy papers were never signed or notorized. It seems to me like this owner is a shady one. My parents have asked for their 10,000 dollars back because the owner will not re write a lease or give them any kind of legal documentation for the house. They just "live" here and keep paying because they are unsure about what they really NEED to do. The owner is now threatening to evict them but how? Theres no lease, no real verbal agreements just alot of threats and unfufilled promises. I advised my parents to retain a lawyer in case he does try to evict. Can anyone give some insight as to what they should do. Please dont respond with ... "they should move" because they already know that they should.. we are just wandering what kind of legal recourse they have in the matter. State is alabama which I beleive requires a 10 day written eviction notice and court procedures.

Lease with option to buy..too good to be true??? My brother in law recently invested in a lease with option to buy program on a $450,000 home. What I find strange is that he just foreclosed on two homes. When I asked him how the program worked he said that all he did was pay $5000 down and $2,200 a month for rent. Although this sounds great, what is the catch??? it can't be that easy with two foreclosures hanging over his head. Does anyone know how rent to own programs work???
